Terms & Conditions
Advanced Plumbing
These Terms and Conditions apply to all proposals, estimates, contracts, services, products, financing references, and work performed or offered by Advanced Plumbing (“Contractor”). By accepting a proposal, estimate, work order, service, or agreement, or by using this website, the customer, owner, general contractor, or other signing party (“Customer”) agrees to be bound by these Terms and Conditions.
1. Acceptance of Work
Any proposal, estimate, or agreement issued by Advanced Plumbing becomes binding upon acceptance by the Customer. Acceptance may be communicated in writing, electronically, or verbally. The Customer’s verbal approval of any proposal, estimate, service, repair, or work order shall be deemed full acceptance of the quoted work, pricing, and these Terms and Conditions, and shall authorize Advanced Plumbing to proceed. Work scheduling, dispatch, mobilization, or commencement of services after verbal approval shall be deemed further evidence of acceptance. Once accepted, Advanced Plumbing is authorized to proceed with and complete the work described, subject to these Terms and Conditions and any approved written change orders.
2. Pricing and Payment
All prices, specifications, and conditions stated in the proposal or contract are deemed accepted upon execution of the agreement or approval of the work.
Payments are due according to the payment schedule set forth in the applicable proposal, estimate, contract, or invoice. The Customer agrees to make all payments in full and on time.
3. Underground Utilities and Concealed Conditions
Advanced Plumbing shall not be responsible for damage to any underground or concealed utility, structure, facility, or obstruction that was not properly located, marked, or disclosed by J.U.L.I.E., the Owner, the Owner’s representatives, the General Contractor, or the construction superintendent.
If concealed conditions, unmarked utilities, obstructions, or differing site conditions are encountered under concrete, asphalt, or within the work area that were not previously disclosed, visible, or reasonably identifiable before work began, any resulting additional labor, materials, equipment, delay, protection, removal, relocation, or restoration shall be considered extra work and billed in addition to the original contract price.
Where immediate action is reasonably necessary to protect persons, property, or the work itself, Advanced Plumbing may proceed without prior written approval, and the reasonable cost of such work shall be added to the contract price and paid by the Customer.
4. Exclusions
Unless specifically stated otherwise in writing, proposals and contracts do not include final grading, site restoration, removal, replacement, or repair of sidewalks, curbs, gutters, asphalt, paved surfaces, landscaping, or other finished surfaces.
Permit fees, permit expediting fees, inspection fees, bond premiums, and governmental, municipal, or third-party charges are also excluded unless expressly stated otherwise in writing.
5. Changes and Extra Work
Any alteration, deviation, modification, or addition to the original scope of work, plans, specifications, or materials that results in additional cost shall be treated as extra work.
Extra work must be approved in writing by the Owner or General Contractor and will be billed in addition to the original contract price. Any such approved changes become part of the agreement.
6. Financing Disclaimer
Any financing company, lender, payment provider, or financing option referenced, linked, advertised, or made available through this website is offered solely as a convenience to the Customer.
Advanced Plumbing is not the lender, creditor, broker, or financing company and makes no representation or warranty regarding the terms, approval, denial, rates, fees, disclosures, servicing, performance, acts, omissions, or conduct of any financing company or financing program. Advanced Plumbing is not responsible or liable for any financing application, approval decision, denial, funding delay, financing terms, payment dispute, billing issue, or any other matter arising out of or related to financing obtained or sought through any third-party financing company.
All questions, disputes, and obligations relating to financing must be directed solely to the applicable financing provider.
7. Sewer Repair and UV Sewer Lining Disclaimer
Not all sewer repairs, sewer replacements, or pipe rehabilitation projects are appropriate or suitable for UV sewer repair, trenchless repair, cured-in-place lining, or similar methods.
The condition of the pipe, extent of damage, pipe material, location, access, configuration, code requirements, and other field conditions may affect whether UV sewer repair is a suitable option. Advanced Plumbing makes no guarantee that any particular repair or replacement method will be appropriate for every project.
The licensed plumber or Contractor representative will determine, in their professional judgment, the best course of action for the specific conditions encountered at the property. Advanced Plumbing reserves the right to recommend an alternative repair or replacement method if UV sewer repair or another trenchless method is determined to be unsuitable, impractical, or not in the best interest of the project.
8. Warranty
Any warranty provided by Advanced Plumbing becomes effective only after full and final payment has been received for all amounts due, including approved change orders, extra work, interest, fees, and other charges.
No warranty applies while any balance remains past due.
Advanced Plumbing warrants its labor and workmanship for a period of twelve (12) months from the date of substantial completion of the work. This warranty applies only to defects arising from Advanced Plumbing’s labor or workmanship.
This warranty does not cover material defects, product defects, equipment defects, manufacturer defects, items covered by a manufacturer’s warranty, or damage caused by misuse, abuse, alteration, lack of maintenance, acts of nature, or work performed by others. Material defects are expressly excluded from Advanced Plumbing’s warranty.
9. Late Payments, Interest, and Collection Costs
Any unpaid balance not paid when due shall accrue interest at the rate of twenty-five percent (25%) per annum from the due date until paid in full.
If any account is placed for collection, referred to an attorney, or legal action is required to enforce payment, the Customer agrees to pay an additional collection charge equal to thirty-three percent (33%) of the unpaid balance, together with all attorneys’ fees, court costs, lien costs, and other collection expenses incurred by Advanced Plumbing.
10. Joint and Several Liability
Any party signing the agreement, including any General Contractor and/or Property Owner, shall be jointly and severally liable for all amounts due under the agreement, including the contract price, approved extras, interest, collection charges, attorneys’ fees, court costs, and any other sums owed.
11. Authority to Sign
Any person signing an agreement with Advanced Plumbing represents and warrants that they are fully authorized to sign and bind the individual, company, property owner, or other party on whose behalf they are signing.
12. No Unlawful Indemnification
Nothing in any proposal, estimate, or agreement with Advanced Plumbing shall be interpreted to require Advanced Plumbing to indemnify or hold harmless any person or entity for that party’s own negligence to the extent prohibited by applicable law.
13. Proposal Validity
Unless otherwise stated in writing, any proposal or estimate issued by Advanced Plumbing shall remain valid for thirty (30) days from the date issued and may be withdrawn earlier by Advanced Plumbing in writing.
14. Governing Terms
These Terms and Conditions apply to all work performed by Advanced Plumbing unless otherwise agreed in a written contract signed by both parties. In the event of a conflict between these Terms and a separately signed written agreement, the signed written agreement shall control.
